DMCA Policy

toogoosh.com respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), it is our policy to respond promptly to claims of copyright infringement committed using our website.

1. Filing a DMCA Complaint

  6. A statement, under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
Important: Incomplete notices may delay processing. Please include as much detail as possible (track files, ISRC, links to proof of ownership, registrations, etc.).

3. Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our DMCA Agent. A valid counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed and the location where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, telephone number, and email address.
  5. A statement that you consent to the jurisdiction of the federal court in your district (or, if you are outside the U.S., the court in which the service provider is located) and that you will accept service of process from the person who provided the original DMCA notification.

4. Repeat Infringers

In appropriate circumstances, Toogoosh will terminate user accounts of repeat infringers in accordance with the DMCA and our Terms of Service.
